1. About Us

Somerset Motor Sports LLC is a limited liability company organized in the Commonwealth of Kentucky, United States, doing business as "Somerset Motor Sports". 2. Eligibility & Accurate Information

You must be at least 18 years old and legally able to enter binding contracts. You agree that all information you supply at checkout — including your legal name, billing address, shipping address, phone number, and email — is true, accurate, and current. Orders with materially inaccurate information may be cancelled and refunded.

3. Order Acceptance

Your submission of an order is an offer to buy. No sale is final until we (a) verify inventory and pricing, (b) confirm your payment has cleared, and (c) send a written order confirmation. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to suspected fraud, pricing or catalog errors, or inability to ship to the destination.

4. Pricing, Taxes & Currency

All prices are shown in United States Dollars (USD). Standard LTL shipping within the 48 contiguous United States is included at $0.00 USD on every order. Applicable state and local sales taxes are shown at checkout where required by law. The price applicable to your order is the price displayed on the product page when the order is placed and confirmed.

5. Payment Methods

We accept the following payment methods, all denominated in USD:

• Bank Wire (Fedwire domestic). Funds typically clear within one (1) business day. Wire instructions are provided at checkout and on the proforma invoice.
• ACH Credit. Funds typically clear within one to three (1–3) business days.

We do not accept credit or debit cards, PayPal, Venmo, CashApp, Zelle, cryptocurrency, or third-party financing. Payment must be received in full within forty-eight (48) hours of order placement or your order may be cancelled and released.

6. Handling & Shipping

Orders are handled within two to five (2–5) business days after payment clears. Free standard shipping is by LTL (less-than-truckload) freight to the 48 contiguous United States and includes residential/marina liftgate or commercial dock delivery at $0.00 USD. Estimated transit time is seven to fourteen (7–14) business days. The carrier will call to schedule a delivery window. Full details are described in our Shipping Policy.

7. Delivery Inspection & Freight Damage

Buyer must inspect the crate at delivery, note any visible damage on the carrier's bill of lading, take photographs, and refuse the shipment if the crate is materially damaged. Concealed damage must be reported to us in writing within seventy-two (72) hours of delivery. Failure to inspect and report damage in accordance with this section may waive freight-damage claims against the carrier and against us.

8. Manufacturer Warranty

All new outboard motors sold on this site are covered by the applicable manufacturer's limited warranty (Yamaha, Mercury, Suzuki, Honda, or Tohatsu). Warranty service must be performed by an authorized service center for the applicable brand; the warranty card and coverage details ship inside the crate. Except for the manufacturer's written limited warranty, and to the fullest extent permitted by law, Somerset Motor Sports LLC disclaims all express and implied warranties, including implied warranties of merchantability and fitness for a particular purpose. We are not the manufacturer and do not extend the manufacturer's warranty.

9. Fitment & Compatibility

Fitment tools and category filters on this site are provided as guidance only. Final compatibility with your vessel — including transom height, controls, rigging, propeller selection, and electrical system — must be confirmed by a qualified marine technician before installation. We are not liable for improper installation or for consequential damages arising from installation performed by anyone other than an authorized service center.

10. Returns, Refunds & Cancellations

Returns are governed by our Return Policy. In summary, unregistered, uninstalled units in their original crate may be returned within thirty (30) days of delivery subject to a return authorization (RMA), inbound freight paid by Buyer, and a restocking fee. Registered, installed, or damaged units are not returnable. Orders may be cancelled without charge if written notice is received before we release the unit to freight.

10.1 Refund Processing

Approved refunds are returned by the same Bank Wire or ACH channel used for the original payment, to an account verified as belonging to the buyer. We do not redirect refunds to third parties.

• Submission window: approved refunds are initiated within one to two (1–2) business days following either (a) written cancellation received before freight release, or (b) completion of inspection at our Somerset, KY receiving facility.
• Settlement window: bank processing times vary; most domestic refunds post within three to ten (3–10) business days after initiation.
• Deductions: the fifteen percent (15%) restocking fee is deducted before the credit is submitted. Standard outbound shipping is not deducted from an approved return refund.
• Refund eligibility: (i) full refund — order cancelled in writing before freight release, or freight-damage refusal properly documented on the BOL; (ii) partial refund (85% of engine price) — unmounted, uncrated engine returned under a valid RMA within thirty (30) days; (iii) not eligible — mounted, started, fueled, oil-added, registered, post-delivery cosmetic damage, missing accessories, or returns received after the 30-day window or without an RMA.
• Confirmation: the buyer receives written confirmation when an approved refund is initiated.

10.2 Payment Disputes

• We use the order acknowledgement, accepted policy versions, tracking, bill of lading, delivery confirmation, and communications to investigate a dispute.
• The return authorization process remains available for eligible products described in the Return Policy.
• Nothing in these Terms limits rights provided by applicable consumer-protection law or by the buyer's financial institution.

11. Export & Compliance

Products sold on this site are sold for delivery within the United States unless otherwise expressly agreed in writing. Buyer is responsible for compliance with all applicable federal, state, and local laws, including EPA and USCG regulations. Buyer will not re-export any product in violation of U.S. export control laws.

12. Intellectual Property

All content on this site — including text, graphics, logos, product images, and the Somerset Motor Sports name and logo — is owned by or licensed to Somerset Motor Sports LLC and is protected by U.S. and international intellectual-property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

13. Limitation of Liability

To the fullest extent permitted by law, Somerset Motor Sports LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site or purchase of products, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising out of or related to a purchase shall not exceed the purchase price paid for the specific product giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Somerset Motor Sports LLC, its officers, employees, and affiliates from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of a product, or your violation of any law or third-party right.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws provisions. Any dispute arising out of or related to these Terms or a purchase shall be resolved exclusively in the state or federal courts located in Pulaski County, Kentucky, and both parties consent to personal jurisdiction and venue there. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. Force Majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, weather, war, civil unrest, labor disputes, carrier delays, pandemics, or governmental action.

17. Privacy

Personal information you submit is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

18. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time you place your order governs that order. Material changes will be posted here with a revised effective date.

19. Entire Agreement & Severability

These Terms, together with the Shipping, Return, and Privacy policies referenced herein, constitute the entire agreement between you and Somerset Motor Sports LLC regarding your purchase. If any provision is held unenforceable, the remaining provisions remain in full force and effect.
